Question #2. Do we HAVE to use an agency?
Does Florida adoption law prohibit independent adoptions? Someone told me that I have to use an agency in order to adopt from Florida. Is it true?

My understanding is that the child HAS to be placed into the legal custody of an agency once the parental rights are terminated. (You can have physical custody, but the agency has legal custody until the adoption is finalized.)

We adopted our daughter who was born in Palm Beach County through an attorney. No agency was involved.

I can second what Yael said! You can just go with an Attorney and that should also save you money!

But.....
We adopted outside of Florida, and our agency was in KS. Since our homestudy was done by an independent SW, we were required by the state of FL to sign on with an agency to do our f/u homestudy before they would approve our ICPC. Not sure why, but it ended up costing us another $1K for no reason!

We did a independent adoption with a lawyer in the Keys. No problems
