Our childrens birthmother contested the first adoption from a Federal prison and even then was not given a free attorney. I hope this helps.

The "free" attorney

... is awarded if you are the respondent in a case where cps has removed the child ... not for a step-parent contested adoption .... the child, however, may be assigned a free attorney for representation of his best interests if it becomes nasty ... but would assume the case is between you, your current spouse and the ex ... not the child in this situation.

In my case FIVE (5) free attorneys were given to the birth mom - BUT she was a juvenile AND in jail - so in that case the answer is yes. In your case I'm not sure.
