This was previously posted on the General Adoption Board but I had very few responses so I was hoping someone over on this forum might know that answer:


Hi there, here is our situation: Our son is currently 19 months old and his adoption is still not finalized. This is due to our agency lawyer (who has now been replaced) setting our paperwork aside and forgetting about it, and now the court system in our county has decided they don't like open adoptions and the finalizations in family court are now backlogged. In the meantime we were matched with our son's birthmother for a second baby, but that match failed when she decided to parent. So, we have decided to go ahead and try for a domestic adoption.

So here's the thing. Our agency says they aren't sure if we can have a second placement since our first is still not finalized. (Matching with a related sibling was apparently okay) Anyone here a lawyer or know the law in NYS regarding adoption? Can you have a second child placed with you while awaiting the finalization of the first?
