Question Re: State Residency Requirements
I posted this message in the Getting Started forum and haven't had any response. I'm hoping someone in this forum has some information or advice. Thanks!
My husband and I are looking at job opportunities in several different states. Two of the states have very lengthy residency requirements related to adoption (meaning we would have to reside in those states between 6 months and 1 year before we could begin the adoption process). Are we right in thinking that the residency requirements will only affect us if we chose to adopt a child from that particular state? Regardless of where we might move, we would always have the option of adopting a child from another state (without residency requirements) or of adopting internationally - isn't that correct? Thanks in advance for your responses! |

No, I believe that in order for your state to licence you to adopt a child, you have to meet your state's requirements. Be that residency, length of marriage, amount of income, etc.

Does anyone out there understand exactly how state residency requirments work? Can we begin the process (home study, etc) before we meet the residency requirement? I thought that the residency requirements just applied to the period prior to the adoption becoming final.

Two things in most states help you establish residency, drivers licensing and untility bills. You can contact a local adoption agency in the state(s) you are considering, they should know the laws. If they don't you could check with an adoption attorney. States are usually pretty strict on residency for things like Medicade, filing for divorce, etc.
