Talking Special Needs Adoption

Can a couple adopt a SN child from China if one spouse is over 30 and the other one is not yet? I thought I read somewhere that if you adopt SN they can waive some of the requirements. Is this true?

The only requirements I have heard being flexible on is the number of existing children in the household.

I have not heard of them bending the rules for the minimum age of 30. You still have to adhere to all the other requirements whether you go SN or NSN.

You can ask an agency and see what they say. Good luck.

No. The age minimum is a matter of Chinese law, not of Chinese policy; therefore, it cannot be waived.

There are no upper age limits in Chinese law, although Chinese policy currently sets an upper limit of 50. In special needs adoptions, therefore, the CCAA can allow some children to be adopted by parents 50-54, in order to make sure that they do not remain in orphanages.

As another example, there are no family size requirements in the law, currently; as a result, it "may" be possible for certain families with 5 or more children to adopt children who are older or who have significant special needs.
