non-residents & international adoption

My husband and I live in Saudi Arabia and are planning on adopting a sibling grouping form Estonia. We are looking for people/person who are nonresidents and have or are trying to adopt overseas. We are particularly interested in the CIC Operations Memorandum published this summer by immigration on allowing nonresident citizens to gain citizenship for their adopted children.

Because we/you are nonresidents we cannot get citizenship for our adopted kids as per the present Citizenship Act BUT the good news is that there has been a loophole developed in the Act due to the hard work of a nonresident family. They were/are non residents and took the Act to court...low and behold they won!! So, this summer Immigration Canada delcared that nonresident Canadians can apply to the Governer In Council for citizenship for their adopted child/ren. BUT, this happens after the adoption is completed. I have to check for the web site that has the Memorandum on it. I will post it soon. So, there you go. It is possible BUT another bunch of hoops to jump through. Also, I am not sure if this memorandum has been tested yet. It sounds like it would be fairly easy...which of course makes me worried. We have decided that we will hire a Canadian lawyer to run interference for us at the first sign of trouble. The other difficulty is that we/you are not going through Canadian agencies and our foreign agencies really don't know how to help us. I guess we/you are on our own here. Hopefully, we will be able jump the hoops after this summer when we pick up our children from Estonia.

I presume you do not have permanent resident status in Saudi, so how difficult is this being an 'expat' when dealing with government agencies both in the adoption country and your home country, plus your current country where you reside? Where did you find an adoption agency? Any tips welcome. Thanks Fi

Cdn non-residents living trying to get home study
I would be interested in learning more on how your particular situation turned out and what you learned.
We are Canadian citizens and live in Turks and Caicos (Caribbean) and want to adopt. We want our kids to be of the same citizenship and so we turn to Canadian adoption services, but with no help. We can't even get by first base - the home study. How can you get a homestudy done when the country you live in doesn't have any such program? We tried to get some Cdn support but nobody returned our calls or emails.?? we are frustrated and at a stailmate. |
