I am currently married to a wonderful man who has been in my twins life since age 18 months. They are now 7. They no noone else as daddy and he is not named on BC. I was recently contacted by "sperm donor's" lawyer because he will soon be on trial for murder. He killed his girlfriend in front of her child. Hubby and I have been attempting to proceed with the adoption for some time now but we keep running into roadblocks. We purchased "How to adopt your stepchild in California" but it is so confusing. we have filed the Petition for Adoption but now need to figure out how to Terminate the Father's right without his consent. He would never ever consent and I don't want him to have to, but there are so many avenues to take that I'm not sure which one is the right one. We are getting so frustrated because the boys are getting up in age and although the school has gone along with helping us change their last names in class it is not legal. We have completed the form for Termination of Rights but they are saying we have to contact him to let him know this is going on??? Isn't there someway of doing this without his consent, especially since he has only been in prison since 1998 and the boys were born in 1993.

Your husband has to file for petition for adoption. Then a letter has to be sent to the biological father requesting for his consent. IF he does not consent to the adoption, you can file to terminate his parental rights on grounds of abandonment. If the biological father have not seen the child for a period of 6 months or more, this is abandonment. You stated that the bio father has been out of their lives since 18 months old and they are now 7. That is a long time. Another thing, you can get him for unfit father if he has not been paying child support. But best of all...he is considered DANGEROUS...if he murdered his girlfriend especially in front of her child. That is TOTALLY BAD>...

and peace of mind.
