My husband has an old arrest does this matter much?
Hi, we have a consultion with a lawyer tomorrow and I am a little nervous. I have been trying to make a list of questions to ask and things to bring up.
My husband was arrested about 7 years ago for assult (bar fight, he was young) and did three years of probation. He completed it with no problems and has not been in trouble with the law since then. That is also the only time he was ever in trouble. Does anyone know if this will make it harder for us to get the step-parent adoption? We have been married for a year and been together since my daughter was two and she is now 7. He is the only father she has known. My ex has been very scarce and is nearly 7 grand behind on support. They are currently trying to serve him with papers and despite my help they have not been able to find him. He is well aware he is supposed to be paying support and I suspect he found a job working under the table to get around the wage garnishment. Any one have advice as to what to bring with me to the meeting or what to ask? |

We were approved for state or domestic adoption and my husband has a few youthful errors of judgement on his record. The most recent was 13 years ago and did count against him/us. If your husband is walking the straight and narrow since his lapse in judgement, I bet you're just fine.

Yes, he has had no other trouble with the law since then. I think he wised up after that. lol

My husband was arrested on drug charges as well. This has nothing to do with the adoption. They do however do a background check, so I would just be truthful about the charges. My attorney said that this couples adoption almost went through and it didnt not because he was charged with a felony but because they tried to cover it up. They were so close to the end also. The thing is that it may get drawn out in court if bio father does contest. So I would just be prepared. Does the bio dad have a criminal record?

We just met with our lawyer on Friday and he told us that my husbands arrest should not be an issue for us since he did probation and did not get in trouble with the law since then. My ex has agreed to consent so that should help us out too.
