Finalizing and court dates
We have signed adoption paperwork and hired our attorney. The attorney's office said to expect 3 months till finalization at the very most. That was almost a month ago.
We just had court - it was a followup just to make sure everything is on track for adoption. So we walk into court and judge says everything is going great and "see you back in 6 months for a continuation". What??? We didn't know anyone there and got kicked out immediately after. So does this mean we can't finalize till the next court date? Or is possible we'll still finalize before then. Any advice is greatly appreciated! |

im assuming
that the continuation is your next permanancy planning hearing....odd are you will finalize prior to that date but they have to schedule it regardless if finalization hasn't already been done after finalization this date usually drops off the calendar which is what happened in my cases

exited2adopt soon,
Congrats on the upcoming adoption! I was wondering: when did you sign your adoption paperwork? Is it after TPR or do you have to wait until an appeals period is over or denied? Did you sign an intent to adopt first? Thanks, mamachell |

Mamachell - In my daughter's case the appeals process lasted 15 months and we had to wait for that to run it's course before signing adoption placement papers. After that it was six weeks until we finalized in court.

We had TPR (which was very simple and easy) and then waited for the appeals period to be over, then we signed our adoption paperwork. We never filed an intent to adopt. I guess things went too fast and I never understood when that should be done. Our SW's didn't really know anything about this whole process. By the way, I'm not sure what point you are at, but just wanted to say that making phone calls really really helped my situation. I tried to educate myself as to where we were at in the process and then I'd make weekly calls to several people involved to see how we could push things along. When we got pushed off to an adoption worker (rather than fost/adopt), our paperwork would have sat on the desk probably for a couple months if I didn't call and discuss the status with them. I'm SO happy I took the time to make calls (I'm usually too quiet and shy to even speak up). Oh and I talked to my lawyers office today and the above poster was correct...the continuation date doesn't matter. Our finalization is still on target to be completed before the end of the year If for some reason things didn't work out right, we'd have the continuation date to discuss why.Wish you the best! |

I should clarify...the birthfamily in my case did not contest or appeal so we just had the standard 60 day waiting period. |
