What happens after TPR?
I heard talk of a "post adoption agreement".. I don't want any formal written agreement re: visits post adoption. I am open to visits but I want it all on my terms, no obligations. Will this be easy?
TPR was granted!!!!!!! Another court date was set where they want to go over the homestudy. What exactly happens then? -- and is it normal that is 4 months from now? |

Congratulations on your upcoming adoption! I am just getting started on the process of becoming licensed (California) so I don't know much. I do remember, however, that in the orientation we were told that by law the adoption hearing cannot be held until at least 120 days (4 months) after TPR is granted. I see in your profile that you are from California, too, so I assume that is why you have to wait 4 months for your next hearing.

No, I think after TPR you have a 60 day appeal period and after that is done, let's say you've had the child in your home 4 month....or 5 months, they subtract that from 6 months and then come up with a court date for finalization...(after the 6 month time in home), at least that was what my cw explained to me at my last homestudy visit. according to my cw the post adoption agreement on visits and such are only really pushed for sibling contact (if there are a vast number of them that were seperated, or adopted earlier and you have the younger kids born to mom) other than that **off the record** my cw told me I don't have to sign any agreement of visitiation and such.

i'm pretty sure in CA you can have your adoption hearing the day after the appeal period is up (60 days), as long as the child has been in your home 6 months already. providing no appeal was filed of course....and provided you are able to get a date quickly.
op, i don't think you have to have a post adoption agreement. we politely declined one for one of our children, and were discouraged from asking for one for another. both in CA. if they really push you and you don't feel comfortable saying no, just say you are willing to send an update letter once a year. you can always do more later. i don't know why your next court date is 4 months out to review a homestudy......ask your worker what the timeline looks like to finalization and what exactly will be discussed at that hearing. they should be able to fill you in. good luck! |
