background checks
i am already the guardian of a little boy but have recently began looking at fostering. I have a few questions though. I am dating someone who lives about two hrs away ad the best way for us to spend time together is to spend a few days together at my place a few times a month.
i know that in dhs eyes that constitues a live in situation and the person would have a background check and all that. The problem is that the person has a DUI on thier record. will that affect anything? they have no other record and its all been taken care of. the packet that they sent that lists things that will be problems lists drug and alcohol felonies but not DUI any first hand expirences? This person isnt a threat or an alcholic the only reason the DUI occured was beacause of a bad situation at the time driving the car was very nesscessary and they were barley over the limit do you think they would take the exact circumstances into account ?

Ask the agency when you call to inquire or ask your liscensing worker if you have one. The exact circumstances may not make a difference, but the DUI may not affect it either. I'm not sure on the details, but know some things in the past may not necessarily disqualify someone.
The other option is to have him stay outside you home, or you outside his, when he visits. Then you wouldn't have to worry about this at all. |

The DUI is most likely not a felony. I think it largely depends how old it is. It would not be a problem in NV as long as he is no longer on probation for it. If its close in time to the present, make a decision that you will not have him for overnights in your house. Should you change your mind after you get your license and have a child placed with you

In NC they take the time into account my husband had an old DUI and we still became licensed but the dui is very old.
