What is the Federal Law for Time in Care (copy needed plz)?

I know is has to do with 19 out of the last 22 months (I think), but I can't find a copy of the law anywhere. We are going to court on Tues and have filed for a change in goals and this would be very helpful. Our girls have been in care 21 straight months now and were close to RU until mom and dad fell WAY off the wagon and their baby brother was taken into custody.

The law is actually 15 of the previous 22 months. It's called the Adoption and Safe Family Act of 1997. http://www.ssw.umich.edu/icwtp/legal...c-asfa1997.pdf

But, this is just a guide line. Since they failed once again, the SW may terminate. I have experienced cases where the children were in care for 21 months and they were returned.

It is my understanding that they ASFA requires a plan for permancy within 18 months. However, the caseworker really holds the power here. My adopted kids were in care for 6 1/2 years before parents rights were terminated (and bio mom was an abandonment case for the last 3 years of that period). And they have been matched and placed with us (adoptive family) for 18 months and the adoption is STILL not finalized.
I applaud you for digging into the laws and standing up for that child's right to permancy. Sometime we (foster/adoptive) parents have to help push the process forward.
