If you'll check on the 'regular forums' about this, you'll see that anyone who's claiming the adoption tax refund this year HAS TO file snail mail, rather than the benefit of e-filing. I personally called our H&R Block guy who's been doing our taxes for years. He told me (as I'd already heard) that we'd be able to file our 8839 now....(He remarked that he'd just done one earlier that day)...that we would need to send in proof of our 2007 and 2009 adoptions (decree)---even though we've already claimed the tax credit in years past ......and the IRS has said it would take approximately (I'm remembering here) 6-8 weeks before a refund would take place. (That time may have been 4-6 weeks...I'm not sure....but certainly, we'd NOT be able to e-file as we've always done in years past.

I know I'd love to e-file this year and certainly, it would be wonderful to get that refund much sooner; but if you think about it, knowing the kind of $$ adoptive parents will be able to get this year, opens the door for a lot of fraudulent people to come in too. I'd much rather send in TOO much paperwork for proof, than not enough and the IRS comes back telling me there'll be a delay and I'd need to send in documents.

That sucks. I wish they'd let those that already filed with a credit previously be able to efile.....considering we never got our entire credit as refund anyways...just as a tax credit instead. I want all mine back then! LOL

Makes no sense.

Yeah, Linny, I don't mind either. I just don't like my personal data going through snail mail. For those of you who are filing the form, remember that you can still request the funds to be auto-drafted into your bank account, which keeps the check from going through the mail, and slightly speeds up the refund. The 6 - 8 weeks for the refund sounds about right, from past history.

Since the IRS STILL hasn't posted the finalized form on their website (nor the instructions), I will be sending our adoption papers, the subsidy agreement (with the pertinent info highlighted) and a copy of the monthly statement from the state showing the amount deposited to our account. That should cover it for any of us.

The finalized Form 8839 for 2010 has been posted at irs.gov. The instructions have not yet been updated, however.

o.k. I looked again. and it is the same place I thought I found it. it says revised date today.. but if you open it, it is still 2009 form, with the 12150.00 amount on it. Did you find one that says 2010 and the new rate?

The irs website says the form will be ready on 2/17, when we did our turbotax it also said 2/17 and they will email us when it is ready, we are impatiently waiting to file our taxes. I will post here when I receive notice from turbotax.

I have always been good ( or so I thought) at finding info like this.. and I didnt even see this update on the irs site regarding 2-17 date! Im going back again!!!!!!!!! jeeeesh! I am nearly past the impatient stage. I dont know what the next level is called, but Im sure it only has 4 letters!

ME AGAIN!! I have been all over today.. I wanted to let everyone know.... IRS SITE IS UPDATED. the REAL 2010 Form 8839 is there now.. I hurried and printed it before it changed again.. go get it fast!!!!!

bummer. I cant file anyway.. Id rather wait till the 17th and be able to efile.. snail mail is not appealing to me at all!!

I called turbo tax today, the rep said it was ready and just go to forms and it will be there. We did that but we still couldn't use it as it says "do not file." The message I got on my turbo tax still says the form will be available 2/17. Go figure!!

Same for me too...forms show up there but it won't let you file.

We finally got our last W-2 form on Saturday and made an appointment with our friend and tax person that afternoon (H&R Block). This guy has been doing our taxes for years-----mainly BECAUSE of the confusion with having the adoption tax credit carry forward for FOUR adoptions over the last eight years.
Our packet was mailed on Monday, Feb 07...'certified'. (Our tax man has retired from the post office as postmaster and suggested we not bother sending it 'return receipt requested' because the IRS receives SO many returns, they don't bother to fill out the info in the form of a receipt---at least that's what the IRS has told him, he said.)

Sooo, it was sent out with the two kids' final adoption decrees (one stating that the one child is special needs) and their birth certificates. (The other two kids' adoption monies have expired.)

Right now...in front of me....are copies of our tax papers. I have the 2010.......form 8839....Qualified Adoption Expenses right here in front of me. I even asked our tax man, "Why is it that I'm reading some people can't get the updated 8839?" And he told me that H&R had/has the file, or it wouldnt' have been available to fill out and file.

Sure enough folks, the form is out because I have it in front of me at this writing. I highly suspect that Turbo-tax...while a great source.....might not have had it 'on file' NOW, because they have to update their own system? I don't really know....just throwing that out.

Our tax guy also said the IRS stated it should take anywhere from 3-6...(maybe it was 7 ?) weeks to process ONCE the IRS had received it all. And yes, we asked to have it direct deposited in our account.
