Special Needs Tax Credit

Wow. What a scenario! I guess so. I think the language of the rule is such that the tax credit can be taken for $10,000, no matter what the expenses are as long as it is considered a Special Needs adoption.

Yes, but the "special needs" adoption tax credit does not go into effect until 2003.
