Hi. My name is Ashlie Miller. I am 17 and I am in dire need of
information pertaining to self-custody, self-adoption or emancipation. I do not live with my parents and I need to know how to get custody over myself without getting my parents in trouble. I am not angry with them, I just feel that I am responsible enough to take care of myself and make medical desicions on my own. I have a job and have basically supported myself for almost a year. I have not had ANY contact with my parents in one whole month and I cannot get a hold of them. I have tried and the phone they had is shut-off, I don't know where they live and I dont know their address. I have NO way of contacting them in case of an emergency or otherwise. I have shown that I am responsible and I deserve to be legally responsible for myself. I am very active in my school and community and I am an honor roll student. I am basically liable for myself as it is, but if something were to happen I wouldn't know what to do because I cannot contact my parents. I have also been considering moving from the state and I cannot legally do this without parental consent. But obviously, I have done what is in my best interest so how do I prove that I can be responsible for myself, since my parents are unreliable. Doesn't this consitute child neglect or desertion? I hear you girl!! I have lived on my own since I was 16! Since you are 17, it may take longer to go through the emancipation process than to just wait it out. I waited it out. Is there something specific that you need a right over (medically, you said...)? If it is an emergency, you, of course can get a court order from a judge to allow the treatment. I dont think there is a way to get self-custody without your parent's permission. I'll pose the question to a friend I have there and see what she says...how long before you turn 18? Christine |

To answer the first reply I live in California. To answer the second reply, I will not be 18 for another ten months. I just feel that I have shown that I can be responsible and I think that I deserve the legal rights to that responsibility.
anyways guys, thanks for your replies. P.S. After I graduate from high school, I will be moving to TX. Ironic, isn't it? |

Well I didnt hear back from my friend yet, so I looked it up....here is a link to what you need to do. File the papers, and when your parents sign them, it will be a temporary order when filed with they court. Once heard by the judge, he will either enter a permanent order or rescind the order depending on his judgement.... If you dont have any pressing issues...I still say to wait it out though....
