I am glad that you are getting what you want. My daughter from my first marriage wanted to have her step-father's, my husband, last name. She had not seen her biological father in about 4 years and the last time she saw him, he was rude, hateful, and condesending. she refused to go back. She was 12 years old and had that right in our state, which, is North Carolina as well.
This past November 25th, 2004, her last name was changed and he signed it but only after I had signed away child support via child support enforcement. He was told three times by our caseworker that I could refile later for the support, which is what my daughter wanted me to do. She feels that he should not be allowed to get out of support just because he doesn't want to have anything to do with his first or second children from his first and second marriages. So, he signed and her amended birth certificate came in a few weeks ago. She was walking on cloud 9. We even had a party.
I hope you get what you want. Had her biological father not signed, she would have done what you are doing now. She is 16, btw.
