Basically, you can only adopt kids whose parents have had their rights terminated. Since most kids are in the foster care system for at least a year before their parents' rights are terminated, most of us have to foster before we adopt. But there are kids who are already legally free for adoption, and who are in the public welfare system. These tend to be kids who are older or who have some emotional disabilities, but you never know who is out there.
I adopted my son from the child welfare system. He came to me when he was 21 days old, and I adopted him when he was 2.
