Bringing baby home!! (and passport question)

Well we are almost past another hurdle!!
With our adoption we adopted domestically, but live internationally. I am in the military and stationed in the Pacific. This has been a crazy hurdle to get past.
We adopted from birth, so I flew my wife back to the states in June to meet the birth mother. I then flew out early July to await the due date. Baby girl was born July 30th, and we flew with the baby back to Penssylvania just two days after her birth!!

Unfortunatly I had to head back over seas a few days later and have been waiting for my wife and daughter to be able to come home. With out a passport we couldnt take baby girl out of the country

Wed our attonrey had a court date and got the paperwork signed to allow us to get the baby a passport!! My wife got the paperwork THursday, but she has to wait on me to send a passport form to allow a minor under 16 to get a passport without both parents present As soon as she has that and makes the passport appointment we can fly them both out here to me!!! I cant wait to finally have my girls with me!!!

My question is, on the birth certificate she received yesterday, it has the borthmoms and father names on it, not ours. But our attorney told us to use our last name on the form I filled out for the baby. Does anyone know if the passport office will have an issue with this?? I had to get it all notarized and Express mailed it (4 days doesnt sound express to me ) so i am hoping its correct and I dont have to do this all over!!

But we were giving a timeline till finalization!!! about 120 days from this court date!!!
