According to my agency, as long as the birth parents have signed the relinquishment papers, the baby can go home with adoptive parents.

However, if the birth parents have not yet signed the relinquishment papers, the baby can only be released from the hospital to someone who is licenced to do foster care.

(Here, the relinquishment cannot be signed until 72 hours after birth, but often the baby is ready to be discharged earlier than that--the choices then are placement with people with a foster care licence or an extra day in the hospital.)
