CPS always threatens to take the healthy kids, but they have to explain to a judge why they did. They can't tell a judge they took the children because you refused to take their rapist back. They can charge you with abandonment and they will and they can and will charge you support. I don't believe they'd take your kids.
What do his doctors feel his chances of recovering with treetment are? Can you and your ex tag team parent while he gets treetment and keep the kids apart? What about using alarms? Has he been treeted in lock up?
I'm sure I'll get plenty of bashing, but this 13 year old is also a child who is repeating abuse he received within your family. Whose to say he can't be rehabilitated? Has he been evaluated?
Have your other children been seen by a therapist who would provide a statement that it would be harmful for them to live with your 13 year old and that removing them from your care would do irrepairable harm?
