Yes, agencies and attorneys sometimes get babies that are many months old. It seems to not happen too often, but it does happen. Our own family came very close to having a baby that was several months old; however, in the end, the situation didn't go through---and without disclosing any details, it wasn't because the birthmother wanted to parent either. ( I won't disclose for the sake of privacy on the part of the birthmother, who really was trying to do the right thing for her baby.)

I've known of other situations...though again, I have to tell you that I don't know of them happening too often.

As far as if babies would go into foster care, I can't tell; but I agree with aclee that the incredibly rising fees for ALL babies are totally ridiculous, and seemingly VERY greedy on the part of some agencies/attorneys.
