Tpr and sibling

Hi. I need a social worker's take on my situation. I am in the process of adopting my infant son in a private adoption. He's been with us since birth. Lo and behold his birthmom may have her rights terminated in 6 months on her 2 yr old. I have been asked if I would adopt her and I said yes. These questions have all been asked through my attorney and I have not had contact wth the worker nor do I have her #, so I would like the answer to these questions please...........

Am I considered a relative placement or foster placement since I have the sibling? (We do have our foster/adopt license)

Does there have to be a court session to get temporary custody? In other words, will this be a lengthy process?

And finally, when a mother has had one child already TPR'd, has had the other one in foster care twice, and recently tested pos. for drugs, will she most likely be TPR'd on the other child even though she's in rehab? The live in boyfriend, father of child was not supposed to leave her alone with the child and he did. I don't think he has tested positive for drugs, but he did lose his license at one point for DUI and they not have a car. Basically I'm afraid of having my heart broken if I get custody of the child and then lose her. I'd like to know there is at least a good chance the case will go to TPR.
