Seems like facilitators would fall under the "other expenses...for which the principal purpose is the legal adoption of an eligible child..." The burden of proof will be on you to justify that to the IRS, though, so you'll have to decide if your facilitator did indeed meet that definition. Facilitators are not legal in my state, so I don't have any direct experience. We have claimed the tax credit, though, and haven't gotten any grief from the IRS for any expenses that we listed.
